Howdy -- unfortunately, Virtualmin only works on Ubuntu LTS releases. For example, Ubuntu 12.04 is the most recent LTS release.
You can see the list of supported OS's here:
http://www.virtualmin.com/os-support.html
Also, note that if you have a running version of Virtualmin GPL, you can always upgrade that to Virtualmin Pro by going into Server Settings -> Upgrade to Virtualmin Pro.

it states there:
Ubuntu 8.04 LTS, 10.04, and 12.04 LTS on i386 or amd64
that last one is the one I use :-)

You mentioned in your post above that you were using Ubuntu 12.10, and not Ubuntu 12.04.
Ubuntu 12.10 isn't an LTS release, Ubuntu 12.04 is the most recent LTS release.
You can verify which Ubuntu version you're using by running this command:
cat /etc/issue
What output do you see from that command?

That's showing that you have Ubuntu 12.10 installed.
The latest version that Virtualmin supports is Ubuntu 12.04, which is an LTS release.
Unfortunately, Virtualmin won't work on the version you have there -- you would need to install Ubuntu 12.04.
