First of all why does this have it's own update mechanism? Just make it part of webmin/virtualmin.
Second the upgrade simply dies. I tell the theme to upgrade and after a few minutes the upgrade simply stops and i find nothing has been done.

well the upgrade to the new virtualmin fixed this issue..:)
What? Don't see how it's related.
Automatic updates just provide a user (if enabled) to see it and update the theme before it's included in Webmin. Update mech uses Webmin to do it. Absolutely safe.

Yeah users get to choose -- you can either receive Authentic updates via Webmin once every month or two when a new Webmin version is released, or you can receive more frequent theme updates if you wish to directly from the Authentic repository.
I suspect we'll be pushing out a new Webmin version today (or very soon), you may want to see if that new Webmin version resolves the issue you're experiencing updating the theme. There is an SSL error that a lot of folks are currently seeing, and that may also be what's going on in your case. Once we sort out the cause we'll push out an update.

The new webmin fixed the update issue..both webmin and the theme updated together..:>)
